I've been playing around in illustration and design programs since I was putting together blog layouts as a teenager.
I'm quite a bit of a doodler, and I love coming up with designs that illustrate an idea clearly while being full of personality.

terms of service

Please read the following thoroughly and carefully before agreeing to work with me.

01: payment & refund policy

Full payment for the entire project is due upfront, and work on the agreed project will not begin until the entirety of the payment due is paid. (This does not include commercial fees, outlined later in 03.A.) Outside of platforms such as Ko-fi/Upwork/Fiverr (which are priced pre-determined on my hourly rate, and automatically take full payment upfront to begin with), the client will be sent an invoice to their email with a full list of payment methods and instructions on how to securely pay.Once paid, refunds will only be issued in the following circumstances:01.A - Full refund: The client will only be entitled to a full refund if requested before they approve of the first proposed design in progress, OR if the client is still waiting for their final product past the agreed turnaround time (the only exception to this is stated in 03.B2 below). They are also entitled to be refunded 100% of their commercial fee, if applicable, at the immediate cost of their rights and ownership to any artwork I have presented to them.01.B - Partial refund: If the client has already approved of the first proposed design in progress, but decides to cancel the project before receiving the final product, they will still be entitled to a refund of 50% of the full project payment. They are also entitled to be refunded 100% of the commercial fee, if applicable, at the immediate cost of their rights and ownership to any artwork I have presented to them.01.C - No refunds of any amount will be issued, for any reason, once the client has received the final product.

02: turnaround

Current proposed turnaround times are as follows, for each type of service:Logo design: Up to 4 weeks (though possibly sooner) from date of payment.
Digital/media design: Up to 6 weeks (though possibly sooner) from date of payment.
Per 01.A above, if the client is still waiting for their final product past the proposed turnaround time for their requested service, they are entitled to a full refund, with the only exception being outlined in 03.B2 below.

03: timeframe

Please read the following for an idea of how the creation process will proceed:03.A - Proposal/First progress image: This stage includes the proposal for the project and the agreement of payment and terms between the client and I. This will include determining the amount of hours to be paid for and the ideal timeframe, according to the client. During this time, using the client's preferred contact method, the client and I will discuss the needs and ideas for the project which will include the first proposed ideas from me. This may come in the form of sketches or from a lower quality, watermarked PNG file, such as the following:

Once the initial ideas and sketches are approved, the process moves on to 03.B. The client is entitled to cancel the project and receive a full refund (01.A) up to their approval of the initial idea, after which they will only be able to receive a partial refund for cancellation (the exception to this also being outlined in 01.A above).03.B - Creation process: This is where the bulk of the process starts, in which the client will be periodically sent lower-quality, watermarked PNG images of their in-progress project for their input. Small changes, such as color palette and minor illustration details, are allowed here, but if the client wants major changes or a full redo of the design, they will either have to accept an extension of 1 to 2 weeks to their agreed turnaround time as well as an additional 2 billed hours, OR a cancellation with a partial refund (see 01.B). Only upon approval of these in-progress images will the process continue to the next stages.03.B2 - Client inactivity clause: Additionally, to prevent clients acting in bad faith to stall for time and obtain a full refund even after approving the first progress image, this clause will also include a requirement for the client to be active in their responses in this process. If there is no response from the client around 48 hours after I initially ask for their input, I will send a final notice, after which if the client does not respond within another 72 hours, they will be issued a partial refund (see 01.B) and the project will be canceled.03.C - Final product: Once the project is finished, one more in-progress image will be shared with the client in the form of another lower-quality, watermarked PNG file and asked for any final, small edits. If approved, the final product will be packed up and sent to the client via email. After this step, the project is complete, and per 01.C above, no more refunds of any kind, for any reason, will be issued after this point.

03: commercial rights

(This is mainly applicable to logo design and illustration services.)The final product, of any kind of logo or illustration service provided, does NOT include commercial rights (Unless paid for upfront, such as via Ko-fi add-ons). The final design will still by all rights belong to me, the designer, unless the client pays the commercial fee outlined in 03.A below.03.A - Commercial fee: In order for the client to obtain full rights and ownership to the created final design, a flat payment of $100 USD must be paid to me, the designer. The option to pay this fee upfront along with the project payment may be offered in cases such as Ko-fi add-ons, but outside of this situation (including after the final product is delivered, if the client did not initially wish for commercial rights) if the client wishes to pay for commercial rights to use the logo or illustration, they may let me know via their preferred contact method, in which case they will be emailed an invoice to be paid. Once this commercial fee is paid, all rights and ownership is turned to the client, and then the design can be used in any way the client sees fit according to their own needs and purposes.A commercial fee is commonly required, but not always. The client will mainly be required to pay the fee if they plan to use the design in ways that will directly profit them as the party represented by the design. Please see the following on how I allow my designs to be used.03.B - The client may use their logo or illustration in the following ways without being required to pay a commercial fee: Social media graphics (profile pictures, profile banners, signatures, in-stream display), website graphics (headers, banners, footers, in-stream display), collateral material (advertising, posters, catalogs, business cards, letterheads)03.C - The client may not use their logo or illustration in the following ways without first paying a commercial fee: Merchandise that earns monetary profit to the client (such as T-shirts, stickers, prints, patches, mugs, etc.)If there is any question or need for clarification on whether the use of a design requires payment of a commercial fee, the client may ask me before, during, or after the design process, mainly via email to thepinkist@gmail.com.

04: AI & NFT usage

I will put this plainly and simply.04.A - I do not authorize any design that belongs to me, at any time, to be used for AI or NFT purposes. If this clause is violated, the client will be blacklisted from any further services from me, the designer, and emailed an invoice for a $100 USD commercial fee (if they have not paid for one previously). If there is a refusal to pay, legal action may be invoked.
